First, what Apple states and what is actual are two different things. If they stated they could, I can't even think of how much of a market loss they would receive from stating this. Also, the Apple man power required to open every phone from every police district in the county would be crazy.
Second, Since the cloud is being more widely used on smart phones, accessing the actual phone is becoming less important. Sure big company, tell me the cloud is secured for individual phone/computer users. NOT!!!

if you don't have your iPhone setup correctly (it's not a factory default setting, surprise!), just guess 9999 times and you have access to the phone. Pretty simple.
