Unfortunately, there are different opinions and approaches to this.
I tend to lean toward the Massad Ayoob school of thought. Not only has he the law enforcement background, but he has been a witness and consultant on actual cases for years, and pretty much knows how things really go down better than anyone.
One question I would ask the author of this article (and this question does come from Ayoob) is does he approach his cases with an affirmative defense?
