The political obsession with power right now should frighten all US Citizens. They really do want the ultimate power over all of us and the only way they can get control is to remove our constituional rights. I am not sure that's true. Contrary to popular belief executive orders are not law. They are merely policy statements and rules that only apply to current employees and last only as long as the current CEO keeps them there.
The next President can wipe them all away in 2 seconds.
It would be the exact same thing if the CEO of Ford Motor Company issued a company directive that salesmen on the road visiting clients cannot take more than an hour for lunch during business hours.
Then the employee thinks he can't take more than an hour lunch on his day off and all customers who buy cars from Ford can never take more than an hour for lunch.
It is an utterly ridiculous notion. Well, it's the same thing. Presidential executive orders are nothing more than policy memos that apply to administration of the federal government and only apply to employees actively engaged in their duties.
In the case of the ATF checks mentioned in the article, the professor is right. The President cannot direct AFT employees to violate the law or expand the law by using criteria that is not on the law. He can tell them not to take more than an hour lunch, but that's about it.
The fun part is that ATF background checks need not result in the transfer of a firearm. A perfectly good way to run a free background check, and there is nothing the Fed's can do. I plan to submit a couple of hundred background checks and never transfer a single gun. I encourage every gun owner to submit 20 a year minimum...
And then when I sell a gun, I will ignore the rule (after all it's not a law)...
