A cop should know when it's appropriate not to arrest. The cop can say "I'm only enforcing the law", but COME ON! The cop should be shamed, too. You could argue that the cop would be held responsible should the old man go and kill someone with his flintlock....ah geez...this is so dumb! Forget it!
I see someone exercising a sense of POWERS and not the sense of duty. The duty to hold people accountable for their crimes and bad actions and not to use the POWER to force people to succumb to your will because you have that authority.
Under federal BATFE categorization regulations that wasn't even a firearm as pertains to possession laws. That would be categorized as an antique and this is an over reach by the officer and DA in the case.
